3.4. There are two sorts of cookies used on our site: session cookies and persistent cookies. Once you close your browser, the session cookie simply terminates, whereas the persistent cookie remains to enable us to track and target your interests to enhance your experience on our site.
3.5. Instant Property may make use of other tracking technologies including, but not limited to, web beacons which are small graphic images or other web-programming code included in webpages and email messages and/or embedded scripts placed on the website designed to collect information about your interactions with any given website.
3.6. These technologies are used in order to collect certain information which may also include personally identifiable information for purposes such as fraud detection and improvement of our website amongst others.
3.7. Instant Property employs the services of a third party in its use of the above technologies and whilst Instant Property takes every precaution to ensure against the loss, misuse, alteration and confidentiality of all information in our possession we have little control over information not in our possession.
- Log Files
4.1. We collect statistical information about you from page hits.
4.2. Every page, image or cgi program requested by your browser from our servers is logged in a log file, which also collects the following information:
4.2.1. your remote IP address;
4.2.2. the referring HTML page and the type of browser and computer that you are using.
4.3. We use IP addresses to analyze trends, administer our site, track your movements, and gather broad demographic information for aggregate use.
4.4. The statistical information we gather is used internally for marketing analysis. This information and IP addresses are not linked to personally identifiable information.
- Sharing
5.1. If you successfully let a commercial property through the website, then your name, email address, phone number and fax number and mailing address may be passed onto the other party involved in that letting transaction in accordance with the Terms of Use.
5.2. For example, if you, as a tenant, successfully lease a property, which you viewed on the website, your details may be passed onto the landlord or owner of that property. Similarly, if you are the landlord or owner of a property displayed on the website, your details will be passed onto the tenant or potential tenant depending on what stage of lease negotiations are currently on going.
5.3. In the event of your personal information being transferred to the other party involved in the lease agreement as above, Instant Property is no longer responsible for and accepts no liability for any unlawful misuse of any information in the possession of either the Landlord or the tenant as the case may be.
5.4. Instant Property will share aggregated demographic information with our business partners and advertisers. When we do, you will not be personally identifiable, and your personal information will only be used as part of an aggregated compilation of information.
5.5. Insofar as you are making an application for a lease or any other application for services that requires a valuation of your credit profile, your letting history on Instant Property will be disclosed to our business partners in order for our business partners to evaluate the risk in providing any such services.
5.6. We will release information about you (as either the landlord / owner or the tenant) to the respective landlord/owner or tenant, as the case may be, in the following circumstances:
5.6.1. Where you, as the landlord/owner or tenant, are no longer contactable pursuant to the signing of a lease agreement;
5.6.2. Where you are not fulfilling your obligations in terms of any lease agreement between yourself and the landlord/owner or tenant as the case may be;
5.6.3. Where you, as the landlord/owner or tenant, are acting illegally or fraudulently.
5.7. This information will also, in addition to the above, only be released to the other party by ourselves in the following circumstances:
5.7.1. upon a formal request by the landlord/owner or tenant, as the case may be, in terms of The Promotion of Access to Information Act (‘PAIA’);
5.7.2. the release of such information is reasonably necessary and appropriate to enforce or apply the Terms of Use of the website;
5.7.3. the release of such information is reasonably necessary and appropriate to protect the rights, property or safety of Instant Property, our users and others; and
5.7.4. access to such information is not refused on any of the grounds for refusal set out in Chapter 4 of Part 3 of PAIA.
5.8. Upon a formal request by the landlord/owner or the tenant, as the case may be, for access to your information for any of the reasons listed in clause 6.7 above, we undertake to notify you of such request (via email) and should you fail to respond to such communication within 7 days of the delivery thereof, your information will be released to the requesting party.
5.9. In accepting these terms and conditions, you hereby consent to the release of your information at the occurrence of any of those circumstances listed in clause 6.7 above as well as any relevant provisions of the Terms of Use of the website and upon any failure by yourself to respond to any notification of a request to your information by the landlord/owner or tenant as the case may be.
5.10. You also agree that we will not be liable to you or any other person for any loss, damage, expense, or other amounts incurred, savings foregone, or hardship suffered, by any person however arising (including where the cause cannot be determined), through the release of your personal details, in accordance with this privacy statement and or the Terms of Use of the website.
5.11. We will also share information, including personally identifiable information about you, with our parent, subsidiaries and related entities in order to provide you with a national trading service.
5.12. All these entities will treat your information according to this privacy policy and in the same manner they would treat their own users’ information.
