5.2. For example, if you, as a tenant, successfully lease a property, which you viewed on the website, your details may be passed onto the landlord or owner of that property. Similarly, if you are the landlord or owner of a property displayed on the website, your details will be passed onto the tenant or potential tenant depending on what stage of lease negotiations are currently on going.
5.3. In the event of your personal information being transferred to the other party involved in the lease agreement as above, Instant Property is no longer responsible for and accepts no liability for any unlawful misuse of any information in the possession of either the Landlord or the tenant as the case may be.
5.4. Instant Property will share aggregated demographic information with our business partners and advertisers. When we do, you will not be personally identifiable, and your personal information will only be used as part of an aggregated compilation of information.
5.5. Insofar as you are making an application for a lease or any other application for services that requires a valuation of your credit profile, your letting history on Instant Property will be disclosed to our business partners in order for our business partners to evaluate the risk in providing any such services.
5.6. We will release information about you (as either the landlord / owner or the tenant) to the respective landlord/owner or tenant, as the case may be, in the following circumstances:
5.6.1. Where you, as the landlord/owner or tenant, are no longer contactable pursuant to the signing of a lease agreement;
5.6.2. Where you are not fulfilling your obligations in terms of any lease agreement between yourself and the landlord/owner or tenant as the case may be;
5.6.3. Where you, as the landlord/owner or tenant, are acting illegally or fraudulently.
5.7. This information will also, in addition to the above, only be released to the other party by ourselves in the following circumstances:
5.7.1. upon a formal request by the landlord/owner or tenant, as the case may be, in terms of The Promotion of Access to Information Act (‘PAIA’);
5.7.3. the release of such information is reasonably necessary and appropriate to protect the rights, property or safety of Instant Property, our users and others; and
5.7.4. access to such information is not refused on any of the grounds for refusal set out in Chapter 4 of Part 3 of PAIA.
5.8. Upon a formal request by the landlord/owner or the tenant, as the case may be, for access to your information for any of the reasons listed in clause 6.7 above, we undertake to notify you of such request (via email) and should you fail to respond to such communication within 7 days of the delivery thereof, your information will be released to the requesting party.
5.11. We will also share information, including personally identifiable information about you, with our parent, subsidiaries and related entities in order to provide you with a national trading service.
